Further Reforms of UK Personal Injury

Claims Regime

The UK Government has announced plans for further drastic reforms of the Personal Injury Claims procedure. The further reforms relate particularly to whiplash claims.

The UK Government already introduced far reaching reforms in the Civil Liability Act which significantly reduced Damages in road traffic accidents via a tariff on compensation levels. The new reforms are expected to have an even more far reaching effect than the most recent reforms.

The new reforms could relate to credit hire, early notification of claims, rehabilitation and recoverability of disbursements and a new procedure for dealing with Personal Injury claims altogether, eliminating or minimising the adversarial element.

The objective seems to be not just to tackle fraud but to reduce costs. Various interest groups have reacted to the initial proposals which will now go through a consultation process.
